1. About FocuzPlay and these terms

FocuzPlay is a puzzle and game service operated by Kooltank Inc. (“we,” “us,” or “our”). These terms govern your use of the service. Our Privacy Policy describes how information is handled.

Please read these terms before creating an account. If you do not agree, do not create an account or use the service.

2. Public usernames and gameplay

FocuzPlay is designed for public play. Your username, gameplay and scores can be viewed by anyone, including visitors without an account.

Public game views, including Live Rooms and leaderboards, may display your puzzle board, moves, progress, elapsed time, scores and results alongside your username. Saved or paused game activity may also be visible after you stop actively playing.

Choose a nickname, not your real name. Do not put your email address, school, birthday, address or other identifying details in your username. Avoid a username you use elsewhere if you do not want people to connect your activity across services.

Other viewers may capture or share publicly visible information. A nickname does not guarantee anonymity, and we cannot control copies independently made by viewers.

FocuzPlay does not provide player-to-player messaging.

3. Accounts and nicknames

Provide a username that meets the service's requirements and keep your password private. Do not use another person's account without permission or impersonate another person or organization.

Do not choose usernames that are abusive, discriminatory, sexually explicit, misleading or that reveal someone else's personal information. We may require a username change or restrict an account to address a violation of these terms.

Where a nickname suggestion feature is available, you may accept, edit or regenerate a suggestion before registration. Suggestions remain subject to availability and the same rules as manually chosen names. A generated nickname is not a promise of anonymity.

Contact us if you suspect unauthorized account access. Never send us your password.

4. Children and guardian involvement

Children and adults may use FocuzPlay. Parents and guardians should help children understand these terms, choose a non-identifying nickname, and understand that their gameplay is public.

If you cannot legally agree to these terms independently, your parent or legal guardian must review and agree on your behalf where required by applicable law.

5. Fair and acceptable use

You must not:

• Access accounts, systems or information without authorization.
• Disrupt the service, introduce malicious code, or deliberately overload it.
• Exploit bugs, manipulate results, or submit fraudulent competitive scores.
• Use automation to submit competitive results unless we have authorized it for testing or another stated purpose.
• Use usernames or other available features to impersonate, abuse or expose personal information about others.
• Use the service in a way that violates applicable law or others' rights.

We may investigate suspicious results and correct or remove scores that are erroneous, manipulated or produced during authorized testing. Report suspected bugs or security issues to [email protected] without accessing other users' information.

6. Saved games, results and availability

Saving, timing, pause and interruption rules vary by game. Follow the instructions shown for the game you are playing. Some unfinished sessions are not saved, and some games end a run when you leave or hide the tab.

We may update games, fix errors, change features or temporarily interrupt service for maintenance or other operational reasons. We do not guarantee uninterrupted availability or that every game or saved result will remain available indefinitely. Any changes remain subject to your rights under applicable law.

FocuzPlay is for recreation. Scores and game performance are not medical assessments or guarantees of educational or cognitive outcomes.

7. Intellectual property

Rights in FocuzPlay's software, branding, design and other protected materials belong to Kooltank Inc. or their respective owners. Subject to these terms, you may access and use the service for its intended purposes. These terms do not transfer ownership of those materials to you or prevent uses permitted by law.

Operating the service includes displaying your chosen username, gameplay and results as described in these terms and the Privacy Policy. We do not claim ownership of your username or personal information merely because you use FocuzPlay.

8. Suspension and account closure

We may restrict or suspend access where reasonably necessary to address a breach of these terms, protect the service or its users, or comply with law. Where appropriate and permitted, we will explain the action and provide a way to contact us about it. Urgent security or abuse situations may require action without advance notice.

You may stop using FocuzPlay at any time. To request account closure or deletion of associated information, contact [email protected]. Handling and retention of information are described in the Privacy Policy.

9. Disclaimers and legal rights

To the extent permitted by applicable law, the service is provided on an “as available” basis, without a promise that it will always be uninterrupted, error-free or suitable for every purpose.

Nothing in these terms excludes or limits a warranty, remedy, liability or consumer right that cannot lawfully be excluded or limited. These terms do not require you to waive mandatory rights under the laws that apply to you.

10. Questions and disputes

Please contact [email protected] with a complaint or dispute so we can try to resolve it. This does not prevent you from exercising legal rights or contacting an appropriate regulator.

11. Changes to these terms

We may update these terms as the service changes. Updated terms will identify their effective date. We will give notice of material changes and request acceptance where required by applicable law. Changes will not override rights that cannot be waived.
